We knew it was coming, but it’s now official:  Governor Abbott signed the bipartisan bill today that makes it legal to produce, process and sell hemp products — including CBD oil — in Texas.  Effective immediately, the bill offers a huge boost to Texas hemp farmers and to consumers who look to CBD as a natural healing aid for a wide array of ailments, from anxiety to epilepsy.

What exactly does the law allow?

The new law allows Texas to set up a federally-approved program for farmers to grow hemp as an industrial crop, including procedures for sampling, inspection and testing. In addition, it expands the kind of hemp products that can be legally purchased in Texas to include any hemp or hemp-derived products that contain less than 0.3% of THC, which is the psychoactive compound found in cannabis plants.  This includes cannabidiol – or CBD.

While Texans have been able to purchase oils, tinctures and other CBD products on shelves for several years, those that contain even trace amounts of THC were technically illegal in the state.  However, now, as long as these products are derived from hemp and contain less than 0.3% THC and meet labeling and quality standards, they’re legal.

Is marijuana still illegal in Texas?

YES, marijuana is still illegal in Texas for both recreational and medicinal purposes.  However, CBD, with its miniscule amount of THC, still provides many of the same natural healing properties – without making one high.

There are a number of forms of CBD, including oils, edibles, vapes, smokeables, and more. CBD oil is the most popular today, although edibles like gummies and chocolate are rapidly increasing in popularity.
