Is CBD legal in Texas?CBD, which is short for “cannabidiol,” is a common chemical compound found in a class called “cannabinoids” that naturally occur in cannabis plants.  Both hemp and marijuana plants fall into the cannabis family. In May, 2019, the Texas Senate unanimously approved House Bill 1325 that legalizes hemp and hemp-derived extracts including CBD as long as they contain no more than 0.3% of THC, the psychoactive compound found in marijuana. In addition to the most recent legislation passed in the Texas Senate, federal legislation was passed in December, 2018 under the Hemp Farming Act, which legalizes both the cultivation and commercial sale of industrial hemp at the federal level.  This Act, which is part of the broader U.S. Farm Bill, effectively removes CBD from the DEA’s list of Controlled Substances.
